Brief Explanations of Commonly Referenced Ordinance Issues

Accessory Buildings

All accessory buildings or structures 120 square feet in area or less, except those related to a farming operation shall be located in the side or rear yard and no closer than five feet to any property line or 20 feet to a side lot line, if adjacent to any public street right-of-way.

The accessory building shall not encroach into a drainage and utility easement or any other public land or right-of-way. Please review the certificate of survey for the subject residence prior to constructing any accessory building. Accessory buildings smaller than 120 square feet do not require a building permit.

Curfew

All of Dakota County is under the same curfew. It is as follows:

If you are under 15:

  • 10 p.m. to 5 a.m. Sunday through Thursday
  • 11 p.m. to 5 a.m. Friday and Saturday

    If you are 15-17:

  • 11 p.m. to 5 a.m. Sunday though Thursday
  • 12:01 to 5:00 a.m. Saturday and Sunday

Fences

A fence is any partition, hedge, structure, wall, or gate erected as a dividing marker, barrier, or enclosure and located along the boundary or within the required yard. Fences must be located on an individual’s property unless the owner of the property adjoining agrees, in writing, that such fence may be erected on the property line. Fences located in the front yard may be no taller than 3˝ feet. Fences taller that 6 feet (with a maximum height of 8 feet) above grade require a building permit. Home Occupations

A home occupation is any occupation that is secondary to the principal residential use, does not affect the residential character of the principal use, and meets the following requirements:

1. The occupation must take place in the principal structure, not within a garage or accessory building. This includes all storage of material related to the home occupation. A professional person may use their residence for consultation, emergency treatment or performance of religious rites, but not for the general practice of the profession when such general practice will involve the need for more than three (3) parking spaces for the occupant and visitors.

2. Only persons residing in that residence may be engaged in the occupation – no employees from outside the home shall be permitted.

3. The home occupation may not be visible from the street.

4. No signs of any kind are permitted.

5. Over-the-counter retail sales are not allowed.The entrance to the home occupation is gained from within the residential space of the home and not through a separate entrance.

Home occupations include such things as:

1. Professional offices – limited to three parking spaces for patrons

2. Minor repair services

3. Photo and Art studios

4. Dress making

5. Nurseries or Child day care centers limited to 14 children

6. Teaching – limited to six (6) students at any one time

7. Hair salon

A home occupation shall not be interpreted to include tourist homes, restaurants, or similar uses.

Parking Regulations

On-street parking is prohibited any time City snowplowing or snow removal operations are in progress.

No parking is permitted within 10 feet of a fire hydrant or mailbox.

On-street parking is prohibited from 3:00 to 6:00 a.m., throughout the year, except for persons rendering emergency medical assistance; construction areas where off-street parking is not available; or the driveway is filled to capacity with no space for additional vehicles without extending into the sidewalk area. Motor vehicles should then be parked at the curb in front of that residence.

Vehicles are considered abandoned motor vehicles if:

  • Parked on public property over 48 hours, or more than 4 hours on properly posted public property and are in an inoperable condition.

  • Parked on private property over 72 hours without permission of the property owner and are in an inoperable condition.

  • Parked outside on private property for 90 days or more and are not properly licensed for operation in the state.

No parking is permitted on grass, gravel, rocks, etc. All areas used for parking must be surfaced with concrete, asphalt or pavers.

No more than four (4) vehicles per dwelling unit may be routinely parked or stored anywhere outside on residentially zoned property. An on-site parking permit may be obtained for two (2) additional vehicles.

One commercial vehicle, not over one ton capacity, may be parked at the owner's or operator's residence. No commercial vehicle in excess of one ton or commercial trailer may be parked or stored in a residential district except to load, unload or render a service.

Setbacks

A setback is the required distance a structure must be from a property line. Please note that setbacks vary by structure type and zoning district, however, listed below are setbacks for some typical structures. Please call the Planning department at (952) 953-2575 prior to building any structure, e.g. shed, fence, compost bins, addition, etc., to discuss the appropriate setbacks.

Please note that no buildings, structures, or uses may be located in or on any public lands, easements, or rights-of-way without approval by the City Council.

1. Accessory buildings smaller than 120 square feet: Five (5) feet from both the rear and side lot lines and six (6) feet from the principal structure.

2. Accessory buildings larger than 120 square feet: Ten (10) from the rear lot line and five (5) feet from the side lot line and six (6) feet from the principle structure.

3. Decks:

Decks located in the front yard may extend into the front setback a distance of eight (8) feet provided they are no more that 1˝ feet above grade and have no railing.

Decks located in the rear yard that are no more that 1˝ feet above grade may extend into the rear yard, but shall be no closer than five (5) feet from the rear property line. Decks that are higher that 1˝ feet above grade may extend no more than twelve (12) feet into the required building setback area.

Signs, Business and Special Promotions

The Planning department processes sign permit applications, and applications for temporary signage for special promotions. The City's sign ordinance prohibits any person from erecting and/or altering any permanent or temporary sign without first submitting a sign application and receiving a sign permit from City staff, unless the sign is exempt under City code. Please contact the Apple Valley Planning office at 952-953-2575 if you have any questions about sign permits.

Permanent Signs

The City of Apple Valley has a sign code that requires all businesses to obtain a sign permit before erecting any building, pylon, or ground sign. The sign permit fee is based upon the floor area of the business and on the zoning district in which the business is located. All signs must be of a permanent nature and must be affixed to the building on a sign band. The City code prohibits paper signs, flashing signs, moveable signs, and painting directly on the building and/or pylon.

In addition to businesses, any single-family or multiple-family residential development must obtain a sign permit before erecting a permanent monument/development sign. These signs must be maintained either by the residents' association or by the City. If the residents' association chooses to have the City maintain the monument sign, the association must pay the City a fee.

Temporary Signs and Special Promotions

All businesses located within the City of Apple Valley are allowed three (3) special outdoor promotions, including sidewalk sales, per calendar year. A permit is required for the special outdoor promotions; there is no fee for this permit. The special outdoor promotions must take place on the business' premises and may not interfere with either pedestrian or vehicular traffic.

A business may erect a temporary banner, balloon, or flags (NO moveable signs and/or changeable copy) to advertise a special promotion or a specific business event, such as a grand opening or special sale. event. The signs must be professional in construction and may not be constructed of paper. Moveable signs and flashing or revolving signs are strictly prohibited. The temporary sign must be located on the property of the business and must be approved by the property owner, not just the leasing tenant or the company erecting the sign. A permit is required for any temporary signs. PDF icon There is no fee for this permit, but it must be approved by the City prior to the installation of the temporary sign. A temporary sign permit generally takes 2 days to review and approve. All applications should be submitted to the City in a timely manner. Signs, Real Estate and Sale

Real estate signs account for 80 percent of the 500-plus signs collected annually by Code Enforcement staff. Whether you plan to sell your home yourself or go through a real estate agency, please remember the following guidelines when placing signage to advertise your home:

  • One sign per frontage (corner lots are allowed two signs) placed within the property lines, not on the right-of-way or boulevard. Typically the right-of-way extends 13 feet behind the curb.

  • Open house signs advertising a particular home that is open for inspection, a limited number of hours, may be placed on City right-of-ways within a six (6) block radius of the open house on the day of the open house and only during the hours of the open house.

  • Directional signs are generally not permitted anywhere in the City.

Tips for Spring

With the advent of spring and warmer weather, residents like to get outside with their families and pets, perhaps taking the campers, cars, and boats out of storage in readiness for an active Minnesota summer. The following are a few Code Enforcement tips to remember while you are preparing to enjoy the outdoors.

  • Picking up litter after your pets and restraining them in public lets everyone enjoy the City sidewalks and parks.

  • Park motor vehicles on a paved surface at all times.

  • Have an extra automobile for sale? It can be parked on a private driveway with a “For Sale” sign displayed or in a zoned automobile sales lot - not in parking lots of commercial businesses or on public streets.

  • Recreational vehicles (boats, trailers, campers, etc.) may be parked on the driveway, not on the front yard.

  • Overnight guests staying for the holidays or a special event will want to park in the driveway to avoid a possible 3:00 to 6:00 a.m. parking violation, unless the driveway is already full. Then be sure to have them park at the curb in front of the residence.

  • Recreational fires are a great way to celebrate spring with the first cookout. Fires should be 25 feet from any structure and not more than 3 feet in diameter, burning only clean, dry, untreated materials.

  • Windows and doors open to enjoy the fresh spring air also let in outside noises. Please remember to limit noise from 10:00 p.m. to 6:00 a.m. and refrain from making the neighbors listen to your music selection.

  • Planning a landscape project? Be sure to keep sidewalks and streets free of all materials – no obstructions allowed.
