Ordinance Proposal: Amending Chapters 155.3, 152, and zoning map regulating shoreland overlay
Summary: The intent of the ordinance is to update the City's “SH” (Shoreland Overlay) zoning district requirements. The City of Apple Valley Planning Commission will conduct a public hearing at its November 3, 2021, meeting, to consider amendments to Chapter 155 (Zoning) of the City Code related to the “SH” (Shoreland Overlay) zoning district. The public hearing for the ordinance amendment has been initiated by the City of Apple Valley as required by State Statute. The State of Minnesota’s Shoreland Management Program guides land development adjacent to lakes to protect their ecological, recreational and economic values. The state shoreland rules (MR 6120.2500 – 6120.3900) establish minimum standards to protect habitat, water quality and preserve property values. Local units of government, including the City of Apple Valley, are required to enact shoreland ordinances that comply with the State shoreland rules. Along with the text update, the DNR is also directing the City to designate the properties that abut Keller Lake, as lots located within the “SH” (Shoreland Overlay) district boundary. The underlying zoning of the residential lots will remain “R-3” (Single family residential, minimum lot size 11,000 sq. ft.) The “SH” (Shoreland Overlay) zone is a zone-on-zone district that contains additional standards for lot area, setbacks, and similar requirements, to help protect adjacent protected waters. Keller Lake is classified by the DNR as a Natural Environment Lake.
